MentoraMedic is not a competent authority under Directive 2005/36/EC and is not accredited, licensed or regulated as such. We provide advice and guidance on the medical qualification recognition procedures governed by that Directive. We are not a law firm, and we do not act on your behalf before CIBG, RGS, IDW (Nuffic), IND or any other authority.

2. What these terms cover

These General Terms and Conditions ("Terms") apply to every contract concluded at a distance between MentoraMedic ("we", "us") and a natural person acting outside the course of a profession or business ("you") through mentoramedic.eu.

By placing an order you confirm that you have read these Terms and agree to their applicability. They are made available before the contract is concluded, in a format you can save and read later, and are attached to your order confirmation email.

Prices shown at checkout include Dutch VAT at 21%. If you are established, permanently addressed and usually resident outside the European Union, Dutch VAT does not apply and the net price is what you pay — see section 5. All prices are in euros.

A package is a relocation package. If you already live in the Netherlands with an EU/EEA qualification, we do not sell you one; you take the individual services you need instead. A qualification from outside the EU/EEA leads to a package only where you already hold the right to live and work in the Netherlands. We do not arrange that right and do not advise on immigration.

4. What is and is not included

Included: our assessment of your route, advice and guidance through each step, and access to our own courses, as set out on the page for the product you buy. You request your documents and submit your applications yourself; we explain what to request and submit, where and in what order, and go through it with you before you do. We do not prepare or collect documents on your behalf, submit applications for you, or correspond with authorities in your name.

Not included: language tuition, sworn translations, apostilles, police clearances, government application fees, BIG registration fees and, where relevant, rent, deposits, travel and insurance. These are invoiced to you directly by the provider or authority concerned.

We introduce you to no employer and speak to no employer on your behalf. You find work yourself; we help you prepare — feedback on your CV and motivation letter, and interview practice — and, once you hold an offer, we explain the CAO framework and salary scales so you can judge it yourself. We do not give legal advice on your employment contract.

We do not guarantee registration, employment, housing or a processing time.

5. VAT for clients outside the EU

If you are established outside the European Union at the time of purchase, no Dutch VAT is due (article 6i(c) Wet op de omzetbelasting 1968). We ask you for a billing address and may ask for further evidence of where you are. If you move to the Netherlands during a package, Dutch VAT applies to instalments falling due after you move; instalments already paid are not adjusted.

6. Payment

Route Audit: payable in full at checkout.

Packages: payable in three instalments of 40%, 30% and 30% of the total, each triggered by a milestone:

The first instalment is charged at checkout. If you bought a Route Audit and continue into a package, the audit fee is credited against that first instalment, and any remainder carries to the next.

7. Card mandate for the later instalments

By ticking the card-mandate box at checkout you authorise us to charge instalments 2 and 3 to the card used for the first payment, each when its milestone is reached. The most that may be charged under the mandate is the total price of your package less what you pay at checkout: at most €1,996.50 on the Relocation Route and €3,085.50 on the Recognition & Relocation Route where no audit fee applies, and less where one does. The exact figure is shown to you before you tick the box and repeated in your confirmation email.

Before each charge we email you at least 7 calendar days in advance with the amount, the charge date, the milestone reached and the document evidencing it. If anything looks wrong, reply before the charge date and we hold the payment while we sort it out.

Revoking the mandate. You may revoke it at any time by emailing info@mentoramedic.eu. Revoking ends the arrangement to pay by card; it does not cancel or reduce what you owe under the contract. We then invoice the remaining amount, payable within 14 days of the invoice date. Statutory interest (article 6:119 BW) and reasonable collection costs may apply to overdue invoices.

If your bank asks to confirm it is you, we send you a link to authenticate. Nothing extra is ever charged through it.

8. Right of withdrawal — Route Audit

You have 14 days to withdraw from this contract without giving a reason. The period starts on the day the contract is concluded. Withdraw by any clear statement: email info@mentoramedic.eu, use the withdrawal function in your cabinet, or use the model form in section 19 and attached to your confirmation email. We refund within 14 days using the same payment method.

If you ask us to start immediately. The checkout page presents two separate requests, each optional and independent of the other:

Withdraw after we have started and you owe a proportionate amount, calculated against the total price of the contract by reference to the part delivered by the day your withdrawal reaches us. Where that total would be excessive, the amount is calculated by reference to the market value of the part performed. We send you the calculation in writing. Your right of withdrawal ends once the audit has been fully performed — you have had both the written assessment and the call.

9. Right of withdrawal and termination — packages

The 14-day right in section 8 applies to packages as well. A package runs for months, so that period will usually expire long before delivery ends.

You may end the contract at any time under article 7:408(1) BW. No notice period, no penalty, no cancellation fee. If you do:

What each phase covers, and what it is worth

The programme runs in three phases. Each carries a share of the total fee, and that share is what the phase is worth — it is the same split as the payment schedule, so what you pay and what you owe track each other.

How the reasonable portion is worked out. A phase you have completed is payable in full at its share. The phase you are in when you end the contract is payable in proportion to what has actually been done within it, and never more than that phase's share — ending the contract in the first week of a phase does not make the whole of that phase payable. Phases not begun are not payable at all. Where applying this would give a figure that is excessive in the circumstances, the amount is calculated instead by reference to the market value of the work performed.

Nothing in this section can produce an amount greater than article 7:411 BW allows, and nothing in it limits your right to end the contract.

This right cannot be waived or restricted, and it applies regardless of anything else in these Terms.

10. Refund guarantee on the Route Audit

Separately from the withdrawal right, we refund the audit fee in full if the assessment concludes that no recognition route is available to you. That means all of the following:

  1. no ground for recognition under Directive 2005/36/EC applies and no national route to BIG registration is open to you;
  2. your qualification is not one the Netherlands regulates as a healthcare profession;
  3. your diploma or its issuing institution cannot be verified by the competent authority of the country that issued it;
  4. you have no right to work in the Netherlands and no ground on which one could be obtained within a foreseeable period.

Disagree with that conclusion? Write to us within 30 days with your reasons; we look at the assessment again and answer you in writing, at no cost to you. If you are still not satisfied, the complaints procedure in section 13 applies.

This guarantee is about our assessment, not about the outcome of any application you make to an authority. It is an additional commitment, given without prejudice to your other rights and remedies under the law, which it neither limits nor replaces.

11. Housing

Housing help is optional and you can leave it out without changing anything else in your programme.

If you want it, we give you a shortlist of short-stay providers who take newcomers, with what each costs and asks for, and we explain how renting here works — what a landlord asks of a newcomer and what to check in a lease. You book and deal with them directly. We do not select properties for you, do not negotiate tenancy terms, and do not stand between you and any provider or agent. We receive no fee, commission or other consideration from any of them, and we charge you nothing for the referral. Any tenancy is between you and the provider; we are not a party to it.

12. Our liability

We perform our services with reasonable care and skill. Where we fail to do so and you suffer loss as a direct result, we are liable in accordance with Dutch law.

We do not exclude or limit our liability for:

For all other claims our liability per contract is limited to the fee you paid us under that contract.

We are not liable for indirect or consequential loss, including loss of income, missed career opportunities, or costs incurred in reliance on an assessment that later proves incorrect, except where excluding that liability would be unreasonably onerous (onredelijk bezwarend) in the circumstances. Nothing in this section limits your statutory rights.

13. Complaints

Email info@mentoramedic.eu. We acknowledge within 5 business days and aim to resolve within 30. If we need longer, we tell you why and when to expect an answer.

14. Disputes

MentoraMedic is not affiliated with, and does not participate in, a consumer dispute-resolution body (geschillencommissie). If we cannot resolve a complaint between us, you may bring the dispute before the competent court. A list of recognised consumer dispute-resolution bodies in the EU is at consumer-redress.ec.europa.eu.

15. Governing law

These Terms and any contract between us are governed by Dutch law. Mandatory consumer-protection rules of the country where you habitually reside apply to the extent they give you greater protection.

16. Personal data

We process personal data in accordance with our Privacy Statement.

17. Changes to these Terms

We may update these Terms. The version in force when you place your order applies to that order. Material changes are published here and, where possible, sent to you by email.

18. Severability

If a provision is found invalid or unenforceable, the rest stays in force, and the invalid provision is replaced by a valid one reflecting its purpose as closely as possible.

19. Model withdrawal form

Complete and return this only if you wish to withdraw. Any other clear statement works just as well.
